If you sell picks on Pickshare, this is your agreement with us. You keep 85%of each subscription; Pickshare keeps a 15% platform fee. You’re an independent seller of opinions — you must keep honest records, never guarantee wins, and handle your own taxes.
Capper Agreement

1. Who this applies to
This Capper Agreement applies to any user who enables capper features and sells picks, analysis or subscriptions on Pickshare (a “Capper”). It supplements — and is part of — our Terms of Service. By becoming a Capper, you agree to it.
2. Eligibility and verification
- You must meet all eligibility requirements in the Terms, including being of legal age (18+, or 21+ where required).
- To receive payouts, you must complete identity and account verification through Stripe Connect. We may withhold payouts until verification is complete.
- You represent that you are legally permitted to sell sports-handicapping content and that doing so does not violate any law, contract, league rule or self-exclusion that applies to you.
3. Your content and picks
- Ownership. You retain ownership of the picks and content you create.
- License. You grant Pickshare a worldwide, non-exclusive license to host, display, distribute and promote your content on the Service, and you grant your paying subscribers a license to access it for their personal use.
- Honest records. Picks and results must be accurate and entered in good faith. Pickshare records performance (win/loss, units, ROI, closing-line value) to keep records transparent and tamper-resistant. You must not manipulate, falsify or retroactively alter results.
- Pick locking. Once an event starts, the selection is locked; you may still settle the result. This protects the integrity of your verified record.
4. Fees and payouts
- Revenue split. For each subscription sale, Pickshare retains a 15% platform fee and you receive 85%. The subscriber pays the price you set.
- How you’re paid. Payments are collected by Stripe as destination charges; your 85% share is routed to your connected Stripe account. Payout timing and minimums are governed by Stripe.
- Refunds & chargebacks. If a charge is refunded or disputed, the associated payout (including your share and fees) may be reversed.
- Changes. We will give prospective notice before changing the platform-fee rate.
5. Taxes — your responsibility
You are an independent contractor, not an employee, partner or agent of Pickshare. You are solely responsible for reporting and paying all taxes on your earnings. Stripe and/or Pickshare may issue tax forms (such as a Form 1099-K) where required, and you must provide accurate tax information. [Counsel: confirm 1099-K / reporting obligations and thresholds.]
6. Prohibited conduct
As a Capper, you must not:
- guarantee wins or profits, or market “locks,” “guaranteed” or “risk-free” picks;
- use or share insider information, or participate in match-fixing or any scheme to influence outcomes;
- falsify, inflate or selectively hide your performance record;
- solicit subscribers to pay or settle off-platform to avoid fees;
- misrepresent yourself as a licensed financial, investment or professional advisor;
- harass subscribers, post unlawful or infringing content, or target minors or self-excluded persons;
- operate multiple accounts to manipulate rankings, reviews or referrals.
7. Performance representations and required disclaimers
Your picks are your opinions. You must make clear that picks are not guarantees, that past performance does not guarantee future results, and that subscribers should bet only what they can afford to lose. You must not discourage responsible-gambling practices. See our Responsible Gambling page.
8. Suspension and termination
We may suspend, limit or terminate your capper status — and withhold or reverse payouts as permitted — if you violate this Agreement or the Terms, or where required for legal, security or fraud reasons. On termination, your obligations regarding honest records, refunds, chargebacks, taxes and indemnification survive.
9. Independent contractor; no agency
Nothing in this Agreement creates an employment, partnership, joint-venture or agency relationship between you and Pickshare. You control how you produce your content within the rules of the Service.
10. Indemnification
You agree to indemnify and hold Pickshare harmless from claims and expenses arising out of your content, your conduct as a Capper, your tax obligations, or your violation of this Agreement, the Terms or any law.
11. Changes
We may update this Agreement. Material changes will be notified (for example, by updating the date above or by email), and continued sale of picks after changes take effect constitutes acceptance.
