Pickshare is a marketplace where independent handicappers (“cappers”) sell their sports picks and analysis. We are not a sportsbook — we never take bets or pay out winnings, and picks are opinions with no guaranteed outcome. You must be of legal age and use the service responsibly.

1. Agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and [PICKSHARE LEGAL ENTITY, e.g. “Pickshare, Inc.”] (“Pickshare,” “we,” “us”). They govern your access to and use of the Pickshare website, applications and services (the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and — if you sell picks — the Capper Agreement. If you do not agree, do not use the Service.
2. What Pickshare is — and is not
Pickshare is an information and content marketplace. Cappers publish sports picks, analysis and commentary; subscribers pay to access that content. Pickshare provides the platform, payment processing and performance tracking that connect them.
Pickshare is not a sportsbook, casino, bookmaker or gambling operator. We do not accept, place, broker or settle wagers; we do not hold betting funds; and we do not pay out gambling winnings. Any bets you choose to place are made with a third-party sportsbook, entirely at your own discretion and risk, subject to that operator’s terms and the laws of your jurisdiction. Picks sold on Pickshare are opinions and entertainment, not financial, investment or professional advice, and carry no guarantee of any outcome.
3. Eligibility
- You must be at least 18 years old, or 21 where required by your jurisdiction, and old enough to participate in sports betting where you live.
- You must not be located in, or a resident of, any jurisdiction where use of the Service or sports-betting-related content is prohibited, and you are responsible for complying with your local laws.
- You must not be listed on any gambling self-exclusion program, and you must not use the Service if you have voluntarily or involuntarily excluded yourself from gambling activities.
- You must provide accurate information and keep your account secure.
4. Accounts
You are responsible for all activity under your account and for keeping your password confidential. One person, one account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Subscriptions, fees and billing
- One-time purchases, no auto-renewal. Subscriptions to a capper are one-time purchases that grant access for a stated period. They do not automatically renew — you will not be charged again unless you choose to re-subscribe.
- Cancellation. You can cancel access at any time; cancellation takes effect immediately and is not pro-rated.
- Refunds. Because access is delivered immediately and does not renew, charges are non-refundable except where required by law.
- Payment processing. Payments are processed by Stripe. By subscribing you authorize the displayed charge. Pickshare retains a platform fee (currently 15%) and remits the remainder to the capper; see the Capper Agreement.
- Prices are shown before purchase and may change prospectively.
6. Acceptable use
You agree not to:
- resell, redistribute, scrape or republish capper content outside the Service;
- circumvent payment, fees, access controls or security;
- upload unlawful, fraudulent, infringing, harassing or misleading content;
- manipulate performance records, reviews, leaderboards or referrals;
- use the Service to facilitate match-fixing, insider information, money laundering, or any illegal activity;
- target or knowingly provide the Service to minors or self-excluded individuals.
7. Picks, performance data and disclaimers
Picks reflect the personal opinions of individual cappers. Pickshare tracks and displays capper performance (win/loss, units, ROI, closing-line value) to promote transparency, but past performance does not guarantee future results. We do not endorse, verify the wisdom of, or guarantee any pick. You are solely responsible for your own betting decisions and any losses you incur.
8. Intellectual property
The Service, including its software, design and trademarks, is owned by Pickshare and its licensors. Cappers retain ownership of the content they post and grant Pickshare and their subscribers a license to use it as described in the Capper Agreement. You receive a limited, personal, non-transferable license to use the Service and the content you have paid to access, for your own non-commercial use.
9. Third-party services and links
The Service integrates third-party providers (for example, payment processing, odds data and sportsbook links). We are not responsible for third-party services, their content, or their availability, and your use of them is governed by their own terms.
10. Disclaimers
The Service and all content are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that any pick will be profitable. [Counsel: tailor to jurisdiction.]
11. Limitation of liability
To the maximum extent permitted by law, Pickshare and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any betting losses, lost profits, or loss of data, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid to Pickshare in the [3] months before the claim or [USD $100]. [Counsel: confirm cap and carve-outs.]
12. Indemnification
You agree to indemnify and hold Pickshare harmless from claims and expenses arising out of your use of the Service, your content, or your violation of these Terms or any law.
13. Dispute resolution and governing law

14. Changes to the Service and Terms

15. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for legal, security or operational reasons. Sections that by their nature should survive termination (for example, payment obligations, disclaimers, limitation of liability and indemnification) will survive.
